Terms of Service

1) Acceptance of Terms & Who We Are

These Terms of Service (“Terms”) govern your use of the PropCheckAI website, mobile application, and related services (collectively, the “Service”). PropCheckAI LLC (“PropCheckAI”, “we”, “us”, “our”) provides the Service. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) Eligibility

You must be at least 18 years old to use the Service. The Service is not directed to minors. Do not use the Service if you are under 18.

3) Definitions & Scope

“Site” means our public website and web pages. “App” means the PropCheckAI mobile application. “User Content” means media and information you upload or submit (e.g., images, videos, frames, panoramas, notes). “Reports” means files you generate or export (e.g., PDFs, QR sheets). These Terms apply to the Site, App, and all related features, including beta/experimental features.

4) Website Use & Content; No Scraping/Framing

The Site and its contents, including text, UI, graphics, logos, and software, are protected by intellectual property laws. Except as expressly permitted, you may not:

• Copy, modify, distribute, mirror, or frame any part of the Site or Service.
• Scrape, crawl, harvest, or use automated means to access the Site or databases.
• Remove proprietary notices or circumvent security measures or access controls.
• Use the Site for unlawful purposes or to infringe privacy or intellectual property rights.

You may link to publicly available pages on the Site in a fair and legal way that does not damage our reputation or suggest any form of endorsement. We may withdraw linking permission at any time.

5) Accounts & Access Rules

If you create an account, you are responsible for safeguarding your credentials and all activity under your account. Do not share credentials except through features we expressly provide (e.g., delegated/role-based access). We may impose or modify storage, bandwidth, or feature limits to protect the Service and users.

6) User Responsibilities; Sensitive Data

• Upload only content you have the lawful right to use.
• Obtain required permissions from property owners/occupants and people depicted.
• Comply with applicable landlord/tenant, privacy, notice, and recording laws in your jurisdiction.
• Do not upload highly sensitive personal data (e.g., government IDs, financial numbers, health data, biometric identifiers) unless you have a lawful basis and all required notices/consents. You are solely responsible for such uploads.
• Do not use the Service for harassment, surveillance, or other unlawful purposes.

7) User Content License & Retention

You retain ownership of your User Content. You grant PropCheckAI a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, transmit, display, and create derivative works of your User Content solely to operate, improve, and provide the Service (including AI processing and Report generation). This license ends when you delete User Content or your account, except that (i) cached/ back-up copies may persist for a limited time (up to 90 days), and (ii) we may retain content as required by law or to enforce these Terms. Training dataset retention, if you explicitly opt in, is governed by our Privacy Policy.

8) AI Tools & Comparison Disclaimer

AI outputs and visual comparisons are informational only and may contain errors (including false positives/negatives). They are not legal advice, certified inspections, or professional determinations. Validate results independently for any legal or contractual use; you assume all risk in relying on AI outputs or comparisons.

9) Reports & Exports

Reports (including QR codes, comparison summaries, annotations, and AI assessments) are for internal/informational use. We do not guarantee their integrity after download, nor accept liability for altered, misused, or misrepresented documents. Do not present Reports as official communications from PropCheckAI or as certified determinations.

10) Plans, Ads & Billing (Apple & Google)

Free users may see third-party ads (e.g., Google AdMob). Ads may use identifiers subject to our Privacy Policy and applicable consent frameworks. Paid plans are billed by platform providers (Apple In-App Purchase and Google Play Billing). PropCheckAI does not process or store payment card data. Plans auto-renew unless canceled in your platform account settings at least 24–48 hours before renewal. Refunds are handled by the respective app stores. Manage/restore purchases via your Apple/Google account settings.

11) AI Credits (Usage, Reuse, Refunds)

A credit is consumed only when starting a new AI Compare for a unique compareKey that has no valid, non-expired prior result. If a valid result exists, AI Reports or re-runs that reuse it do not consume credits. If an AI run fails to produce results, the consumed credit is automatically returned. Credit and reuse logic may rely on versioned manifests and model versions; details appear in product documentation.

12) AI Training Program (Explicit Opt-In)

Participation in our AI training program is optional and controlled by a toggle in Settings. If you opt in, you grant us permission to use select assets (e.g., frames, crops/patches, overlays, model outputs, and your marks/overrides, plus minimal technical metadata) to improve detection quality. Participation is recorded (e.g., consent.aiTraining, timestamp). You can withdraw at any time; withdrawal stops future use and schedules deletion of training assets as described in our Privacy Policy (subject to legal holds and non-identifiable aggregates). Non-participating users are not included in AI training.

13) Third-Party Services & Links

The Service relies on third-party providers such as Google Firebase (Auth/Firestore/ Storage), Google AdMob, Apple App Store and Google Play (billing), and Hugging Face (inference). Use of the Service entails use of these providers, subject to their terms and privacy practices. The Site may contain links to third-party sites; we are not responsible for their content or practices.

14) Feedback & Submissions

If you send ideas, feedback, or suggestions, you grant PropCheckAI a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation. If you submit media for promotional purposes, you represent and warrant that you have all necessary rights and permissions to grant us the right to use, publish, and edit such content for marketing and communications.

15) Prohibited Uses

• Illegal, infringing, deceptive, or harmful activity.
• Attempted security breaches or interference with the Service.
• Bulk extraction, scraping, or automated data harvesting.
• Misuse of brand assets, false affiliation, or impersonation.
• Capturing or including faces, precise addresses, access codes, or other sensitive identifiers where prohibited by law, lease terms, or posted notices, or failing to comply with applicable recording/notice obligations.

16) DMCA / IP Complaints

If you believe content infringes your rights, email support@propcheckai.com with: (a) identification of the copyrighted work; (b) the allegedly infringing material and its location; (c) your contact information; (d) a statement of good-faith belief and accuracy; and (e) your signature. We may remove content and, for repeat infringement, terminate accounts.

17) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UPTIME, ACCURACY, OR ERROR-FREE OPERATION.

18) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PropCheckAI LLC AND ITS DEVELOPERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. FOR FREE-TIER USERS WHO PAID NO FEES, OUR TOTAL LIABILITY IS US$0.

Nothing in these Terms limits liability that cannot be limited under applicable law.

19) Indemnification

You agree to indemnify and hold harmless PropCheckAI and its developers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

20) Governing Law; Arbitration; Class Waiver

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Any dispute arising out of or relating to the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Rules in Boston, Massachusetts, unless we agree otherwise or you may bring a claim in small-claims court. YOU AND WE WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@propcheckai.com with subject “Arbitration Opt-Out” and your account email.

21) Export Controls & Sanctions

You may not use the Service if you are, or are working for, a person or entity barred by export controls or sanctions, or in embargoed jurisdictions. You agree to comply with all applicable export and sanctions laws and regulations.

22) Assignment; Severability; Force Majeure; Entire Agreement

You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or asset sale. If any provision is unenforceable, the remainder remains in effect. We are not liable for delays or failures due to events beyond our reasonable control. These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject.

23) Changes to These Terms

We may update these Terms by posting the revised version on this page (and in the App, if applicable) with a new “Last updated” date. Your continued use after changes constitutes acceptance. Please review this page periodically.

24) Privacy & Cookies

Our collection and use of personal data is described in our Privacy Policy, which is incorporated by reference. For information about cookies and web tracking, see our Cookie Policy. The Privacy Policy includes details on AI training (opt-in), retention, international transfers, and your choices.
